- General Policy Statement
- Olipure Global (the dedicated export division of Sbuk Agro) adheres to strict international food safety standards, moisture controls, and lab testing parameters for all exported agricultural commodities. Due to nature of bulk food commodities, international customs restrictions, and transoceanic logistics costs, physical returns of shipped cargo are strictly not accepted once a container has been loaded on board the vessel.
- 2. Quality & Weight Certification at Origin
- Final Inspection at Loading Port: All consignments are inspected, tested, and certified at the port of origin (India) prior to vessel loading.
- Official Documentation: Standard export documentation—including Phytosanitary Certificates, FSSAI compliance, and Certificates of Weight & Quality—issued at origin serve as primary proof of contract compliance.
- Third-Party Pre-Shipment Inspection: Buyers may request an independent pre-shipment inspection (by SGS, Intertek, or Geo-Chem) at the loading port at their own expense prior to container sealing. Once sealed and certified by an independent surveyor at origin, the cargo is deemed fully compliant with contractual specifications.
- 3. Cargo Damage During Sea Transit
- FOB Shipments: Risk of loss or damage transfers to the buyer upon container loading at the Indian origin port. Damage occurring during ocean transit must be claimed directly against the buyer’s freight forwarder or marine insurer.
- CIF Shipments: For orders shipped under CIF terms, marine insurance coverage is arranged by Olipure Global on behalf of the buyer. In the event of transit damage or container breach during sea voyage, claims must be filed immediately against the insurance policy using the Marine Insurance Certificate provided in the original document set.
- 4. Quality Deviation & Shortage Claim Procedure
- If a buyer claims that cargo delivered at the destination port fails to meet contractual parameters (e.g., severe moisture variance, bag count discrepancy, or container seal tampering):
- Notice Window: The buyer must submit a formal written claim notice to Olipure Global within five (5) calendar days of container arrival at the destination port and prior to cargo unloading/processing.
- Supporting Evidence Required: The claim notice must be accompanied by:
–Photographs and videos showing intact container seals, container numbers, and damaged/affected bags.
–Official Joint Survey Report or independent inspection certificate issued by an internationally recognized surveyor (such as SGS or Intertek) at the destination port.
–A copy of the initial customs tally sheet and Bill of Lading.
- Evaluation: Claims submitted without an accredited third-party surveyor report, or submitted after cargo has been moved out of the port/processed into secondary facilities, will be automatically rejected.
- 5. Resolution & Compensation Limits
- If a quality deviation or weight shortage claim is validated by mutual agreement and supported by independent lab evidence, Olipure Global’s total financial liability shall be strictly limited to:
–A mutually agreed credit note applied against the buyer’s subsequent commercial container order, OR
–A partial financial adjustment proportional to the verified non-conforming quantity.
- In no event shall Olipure Global or Sbuk Agro be liable for indirect, consequential, lost profit, or secondary processing damages incurred by the buyer.
